The court adjourned the cases against Ajay Kumar Das, 23, of Rajviraj Municipality-1 Padaria and Nizamuddin Mian, 27, of the same place, and Gafar Mian of Rajviraj, 28, Municipality-8, Pani Tanki on the charge of Kidnapping and Hostage on May 23, 2023.
The bench of District Judge Dr. Rajendra Prasad Acharya adjourned the case against the absconding accused. According to the locals of the accused’s village, the absconding accused Gafar is in Qatar for foreign employment and Nizamuddin is in Pokhara.
The victim filed a case against Rashid Mian, 29, and Mushtaq Mian, 28, of Rajviraj Municipality-1 Padaria, accusing them of kidnapping the victim, on the night of September 28, 2021, and holding them hostage. The police registered the complaint on October 3, 2021.
The victim said that the accused surrounded him, on a road near Gulab Garage in Rajviraj Municipality-8 Kanchanrup Road, beat him with weapons, and covered his mouth with a cloth. After this, he was taken hostage in a poultry farm 300 meters away from the location of the incident.
Along with the complaint, the victim submitted a video of the accused beating him by tying him to a bamboo pole with a rope and pouring water on him, as evidence to the police. The victim, who managed to escape from the clutches of the accused, was treated at Gajendra Narayan Singh Hospital in Rajviraj on September 29, 2021.
The district police office had registered a complaint of kidnapping and body hostage on October 3, 2021. Among the accused, Rashid and Mushtaq were arrested on November 12, 2021. According to the order of the court, a charge sheet was filed in the district court on December 6, 2021. The accused Rasid and Mushtaq were remanded to judicial custody in Rajviraj Jail on October 9, 2021.
Judge Dr. Rajendra Prasad Acharya’s bench on May 23, reinstated the case under the charge of beating and dismemberment and sentenced Rashid and Mustaqa to one-year imprisonment and Rs,10,000 fine. The prison administration said that although the term of imprisonment has been completed, they are still in custody for other criminal offenses.
