High Court Mandates Filing of a Certified Report Regarding Public Concern

Since the report prepared by Beladadi Rural Municipality was found to be uncertified, the Dipayal–Mahendranagar bench of the High Court, in its meeting on Nov 11, 2025, issued an order in the name of the respondents to appear before the High Court on Nov 23, 2025 with a certified report.

INSEC, Advocacy Forum, and the Environmental Human Rights Network had filed a writ petition on Jan 2, 2025 against Mahakali Sugar Industries Pvt. Ltd. at the Dipayal–Mahendranagar bench of the High Court. A joint bench of Judges Govinda Joshi and Giriraj Gautam issued the order.

On Jan 10, 2025, a joint bench of Judges Dinesh Prasad Yadav and Ujjal Shukla at the Mahendranagar bench issued an interim order noting the following in the writ petition: INSEC, one of the petitioning institutions, had conducted a field study on June 12, 2023, which found that Mahakali Sugar Industries Pvt. Ltd., one of the respondents, was indiscriminately discharging chemical-mixed waste on roads and into natural drainage; that local residents were suffering due to the stench and waste generated by the industry; and that the local municipalities had taken no initiative to ensure social responsibility. The court observed that operating the sugar mill without meeting legal standards and failing to properly manage waste had violated the right to a clean environment, the right to health, and other fundamental and legal rights guaranteed by the Constitution.

From the perspective of balancing convenience, the court ordered Mahakali Sugar Industries Pvt. Ltd. to operate the factory in compliance with the legally prescribed standards, minimizing environmental pollution and adverse impacts on human health as much as possible. The court further directed Belauri Municipality and Beladadi Rural Municipality to monitor whether the industry was operating according to the law and the court’s orders, and to submit a report to the court within one month.

Although Belauri Municipality and Beladadi Rural Municipality had been ordered to submit monitoring reports on whether Mahakali Sugar Industries was operating in accordance with the law, Beladadi Rural Municipality submitted an uncertified monitoring report. Therefore, the Dipayal–Mahendranagar bench of the High Court issued a new order requiring submission of a certified report, according to Advocate Bir Bahadur Bista, who participated in the hearing on behalf of the petitioners.

INSEC, Advocacy Forum, and the Environmental Human Rights Network had filed a writ petition on Jan 1, 2025 against Mahakali Sugar Industries Pvt. Ltd. at the Dipayal–Mahendranagar bench of the High Court. In the hearing held on January 2, Judge Dinesh Prasad Yadav issued a first order directing the respondents to submit the grounds and evidence for not issuing an order against them within 15 days.

Khadkaraj Joshi, Coordinator of the INSEC Sudurpaschim Provincial Office, Dhangadhi, stated that residents of Ward 10, Belauri Municipality, Kanchanpur, had raised complaints that the waste discharged from Mahakali Sugar Industries Pvt. Ltd. had adversely affected their health and livelihoods. After conducting a field study, INSEC had requested the concerned authorities to ensure that the mill operated in compliance with required standards. However, when Mahakali Sugar Industries failed to take any action, INSEC, Advocacy Forum, and the Environmental Human Rights Network jointly filed the writ petition at the Dipayal–Mahendranagar bench of the High Court in response to citizens’ concerns regarding this matter of public interest.
