Civil Society Organizations Demand to Prepare the Province Civil Service Bill 2078 According to the Constitution and Law

Civil Society Organizations issued a memorandum and a press release on August 29 and demanded that the Bill, which was passed by the Sudurpaschim Assembly, to regulate the formation, operation, and conditions of service of the Sudurpaschim Province Civil Service, should be made in accordance with the constitution and laws.

A memorandum to the head of the Sudurpaschim Province stating that the provision of the third level of support to various employees working on contracts and temporarily employed on the basis of internal evaluation is contrary to the constitution and the law in Sub-section 3 of Section 5 of the Provincial Civil Service Bill passed by the Sudurpaschim Province Assembly.

INSEC Sudurpaschim Province Coordinator Khadak Raj Joshi said that after receiving the memorandum from the head of Sudurpaschim Devraj Joshi, he has studied the civil service bill passed by the provincial assembly and found it necessary to make revisions. It will be sent back to the provincial assembly for revision and it will be verified in accordance with the constitution and laws.

INSEC Sudurpaschim Province Coordinator Khadak Raj Joshi, District Court Bar Kailali’s Chairperson Siddharaj Ojha, Journalist Federation, Kailali’s Chairperson Himal Joshi, Consumer Interest Protection Forum’s Vice Chairperson Dhanapati Dhungel, Non-Governmental Organizations Federation, Sudurpaschim Province Chairperson Devi Khanal, FI Nepal Program Director Sher Bahadur Basnet, FIAN released a joint press statement and memorandum signed by Mukund Rana, coordinator of the Sudurpaschim Province of Nepal, in the article 244 of the Constitution of Nepal.  The Sudur Paschim Province Government has established the Provincial Public Service Commission, and in the Provincial Civil Service Bill, to provide for the permanent appointment of authorized officials based on the internal evaluation. It has been mentioned that the jurisdiction of the Service Commission has been violated.

It is said in the statement and memorandum, “We condemn to protect the right of the citizens to compete freely without passing the provisions of the Act contrary to the constitutional and legal provisions.”

The Sudurpaschim Province Assembly passed the Bill on August 28 to regulate the formation, operation and service conditions of the Sudurpaschim Province Civil Service.
