Victim Called INSEC for Legal Assistance in Police Mistreatment Case

A 47-year-old woman, Ashamai Tamang (Lama), originally from Boudha Metropolitan City-6, Kathmandu, and residing in Chautara Sangachokgadhi Municipality-6, Gourati, has alleged that she was abused by police officer at the gate of the district court. She applied to INSEC on September 25, seeking assistance in the legal process. She claimed that the police officer stopped her from entering the court, took her to a secluded location in Syaule, and assaulted her, causing bruises and injuries.

In the application submitted to INSEC, it is mentioned that when Tamang tried to file a case in court starting on September 12, the court-appointed lawyer refused to register the case, and the court officers were uncooperative. Subsequently, when they protested by staying at the court gate, she was harassed and tortured by the police on September 24. INSEC’s district representative met with District Court Judge Prem Prasad Paudyal and District Judge Bhagwati Sharma on September 25. They stated that Ashamai Tamang was removed from the location due to her actions, which interfered with the court’s work. DSP Niranjan Bhattarai of the District Police Office stated that they took her to Syaule, where she resides due to unnecessary disputes in the premises of the court and the District Police Office, including knocking on the office gate and obstructing work.

Tamang says that three years ago, she approached various agencies seeking compensation for a dispute over the digging of a road through her land. And, two years ago regarding the same case the National Human Rights Commission also sent a written letter to the Ministry of Home Affairs, requesting that Tamang be compensated with Rs 50,000, concluding that the District Police Office had illegally arrested and mistreated her. Ashamai Tamang said that after trying many places for justice, she had come back to the district to seek justice again when the incident happened.
