Order to Register Case of Induced Abortion due to Assault, Submitted

On July 23, a warrant was submitted to the district police office to register a complaint against  23-year-old Mamda, alias Palia Khatun, a 20-year-old resident of Rajdebi Toll, Rajviraj Municipality-2. The complaint alleged the accused of inducing abortion of Sabia Pravin.

Manohar Kumar Pokharel, the former representative of INSEC, accompanied the complainant, Akbar Ali, to the district police office and submitted a letter along with a certified copy of the court order.

The High Court Janakpur Rajviraj Bench issued an order on June 9 to register the complaint filed by the victim and proceed with the proceedings. On July 23, the court sent an information letter with a certified copy to the District Police Office. The case branch mentioned that they will register the complaint after comprehending the court’s letter.

According to the incident, Sabia, who was 17 weeks pregnant, suffered a miscarriage after being assaulted by her sister-in-law, Palia Khatun, on March 5. Palia Khatun had visited the Maternal House, where Sabia was resting during her pregnancy. The victim was pushed and injured in the stomach while sitting on a chair. After being examined by Dr. Usha Dev, it was determined that the baby was no longer moving in the womb, leading to her admission to Chinmasta Hospital in Rajviraj. On March 6, the hospital confirmed the demise of the unborn child during an ultrasound examination.

The victim immediately reported the incident to the police station at Rajdebi Chowk and subsequently filed a complaint at the district police office. On March 15, the victim’s father, Akbar Ali, lodged a written complaint at the district police office. The victim also sent a registry letter to the District Public Prosecutor’s Office on March 26 and to the District Police Office via post on April 20. However, the police did not proceed with the case without registering a formal complaint, leading the victim to file an application for an injunction before the High Court.

The order issued by High Court Judges Munendra Prasad Awasthi and Tejnarayan Singh Rai on June 9 was verified on July 14. As a result, the court sent a letter with a certified copy to the District Police Office on July 23 to provide necessary information.
