The opposition collation members of Dissolved House of Representatives have filed a writ petition in the Supreme Court for demanding the restoration of the dissolved House of Representatives.
According to the Nepali Congress leader Gagan Kumar Thapa, a total of 146 parliament members from Nepali Congress, CPN (Maoist Center), Madhav Kumar Nepal faction of CPN (UML), Upendra Yadav faction of Janata Samajbadi Party and Rastriya Janamorcha have filed a petition May 24 in the Supreme Court. The parliamentarians demanded to the restoration of the dissolved House of Representative and appoint the main opposition leader Sher Bahadur Deuba as the Prime Minister in accordance with the Article 76(5) of the Constitution of Nepal.
Despite the signatures of the a majority of members of the House of Representatives submitted in the support of main-opposition leader Sher Bahadur Deuba as prime minister, President Bidhya Devi Bhandari dissolved parliament on May 22 and called for mid-term election. Opposition groups have reached to the Supreme Court with the petition saying that the president and prime minister had taken unconstitutional measures.
The petition filed by the members of parliament in the Supreme Court demands to appoint Sher Bahadur Deuba as the Prime Minister in accordance with the Article 76(5) and restore the dissolved House of Representative by declaring the entire proceedings unconstitutional and illegal. 146 parliamentarians of the dissolved house were present in the Supreme Court to file the petition.
