Protect the Right to Live a Clean and Healthy Environment: Commission

The National Human Rights Commission has directed the Government of Nepal to take effective measures for the protection and promotion of the fundamental right and human right to live in a clean, healthy, and sustainable environment.

In a press release issued on World Environment Day on June 5, the Commission stated that it has drawn the attention of all concerned stakeholders to the protection and promotion of the fundamental right and human right to live in a clean, healthy, and sustainable environment as guaranteed by the Constitution of Nepal and international human rights standards.

The Commission noted that Article 30 of the Constitution of Nepal guarantees every citizen the right to live in a clean environment. Although the Constitution assigns the State the responsibility for controlling environmental pollution and minimizing environmental damage, the Commission stated that sufficient attention has not been given to this responsibility.

The Commission expressed serious concern about the increasingly complex environmental situation in recent years, driven by air pollution, deforestation, climate change, poor waste management, and the unsustainable exploitation of natural resources. It noted that these issues have had adverse impacts on public health, livelihoods, and living standards.

According to the press release, complaints have been filed with the Commission regarding the negative environmental impacts caused by the indiscriminate dumping of waste in Madhyapur Thimi, and attempts to establish a dumping site by force in a residential area of Amargadhi Municipality despite opposition from residents. The cases are currently under review and action.

The Commission has urged the public to take environmental pollution risks seriously, remain vigilant, actively participate in environmental conservation efforts, and support initiatives aimed at reducing pollution.

The press release, issued by Dr. Tikaram Pokharel, Joint Secretary and Spokesperson of the Commission, also appealed to all concerned to contribute to the conservation of biodiversity and the creation of a safe and sustainable environment for present and future generations.
