Demanding the implementation of the provisions contained in the Koshi Province Child Protection Act, 2020, the Informal Sector Service Centre (INSEC), Koshi Province Office, Biratnagar, filed a writ petition seeking a certiorari-cum-mandamus order before the High Court, Biratnagar, on June 18, 2026, naming the Office of the Chief Minister among the respondents.
INSEC Koshi Province Coordinator Manohar Kumar Pokharel stated that the writ petition was filed against the Office of the Chief Minister and Council of Ministers, the Ministry of Social Development, and the Koshi Province Child Rights Committee.
Among the provisions of the Koshi Province Child Protection Act, 2020, is a requirement that the Province Child Rights Committee prepare and submit an annual report to the provincial government covering the overall situation of children in the province, the status of child rights protection and violations, the condition of children in alternative care, and the quality and effectiveness of services provided to them. However, as this provision has not been implemented for the past six years, INSEC filed the writ petition against the Koshi Province Government.
Coordinator Pokharel stated that the writ petition was filed on June 18, 2026, after the Province Child Rights Committee failed to submit the annual reports required under the Koshi Province Child Protection Act, 2020, despite six years having passed since the law came into effect.
The writ further demands the implementation of legal provisions related to child participation, the establishment of a Provincial Child Fund, and the formation of a provincial-level child club network, arguing that the Koshi Province Child Rights Committee has failed to fulfill its statutory duties and uphold the rule of law.
The writ petition seeking a certiorari-cum-mandamus order also calls for the full implementation of children’s fundamental rights guaranteed under Article 39 of the Constitution of Nepal and the effective enforcement of the Child Protection Act, 2020, which came into force in Koshi Province on August 9, 2020.
