NHRC Receives Memorandum Urging Justice for the Victim of Custodial Death

The family of Kiran Rai, also known as Bhudeu, a resident of Diktel Rupakot Majhuwagadi- 10 has requested the attention of the National Human Rights Commission demanding action against those involved in Rai’s murder.

Kiran’s father Buddhi Bahadur Rai informed that a memorandum was submitted to National Human Rights Commission’s sub-regional office Khotang urging action against the perpetrators involved in the torture and killing of his son inside the police custody.

Kiran Rai was arrested on the charge of killing on June 11, 2013, and died in police custody on July 10, 2013.

His father told INSEC that those involved in the killing of his son have not been prosecuted and they have not received justice even after nine years of the incident.

Mr. Shyambabu Kafle, Deputy Secretary of the National Human Rights Commission’s sub-regional office, Khotang, said that even though the perpetrators of Kiran’s murder have been identified, no action has been taken against them.

According to the father of the victim, the perpetrators of Kiran’s murder have been identified and are walking freely however no action has been taken against them. The family of the victim submitted the memorandum and requested the Commission to facilitate the judicial process, informed Shyam Babu Kafle, Deputy Secretary of National Human Rights Commission sub-regional office, Khotang.

Kiran had tried to escape after being arrested and according to his father, he died due to physical torture by the police who brought him back.

The National Human Rights Commission had recommended the government to take action against the then DSP Rajeev Basnet, Inspector Ramesh Dev and 11 other police officers in the case of the death of the detainee Kiran in police custody.

The alleged of the incident are DSP Rajeev Basnet, Inspector Ramesh Dev, Sub-Inspectors Mahendra Khatri, Mukunda Prasad Bidari, Constable Suresh Prasad Yadav, Policemen Nakul Rai, Ramkumar Bogati, Kailash Khatri, Chandra Khadka, Devraj Majhi and Narayan Khadka.

The commission had recommended the Office of the Prime Minister and the Council of Ministers take action against the accused on September 4, 2013.

Sanjeev Rai, a relative of the deceased, said that although the decision and recommendation of the commission were upheld by the Mandamus of the temporary bench of Okhaldhunga, justice was not received.

The Commission had recommended to the Office of the Prime Minister and the Council of Ministers to take action against them as per the provisions of the then Muluki Ain.

According to Section 16 of 3 of the Commission Act 2011, the commission had recommended giving NPR 300,000 compensation to the victim however, the execution has not been carried out yet, added Sanjeev Rai.

The post-mortem of the dead body was done at the district hospital on July 11, 2013 and the final rites of the victim were conducted on the same day.
