Children are kept in Jail along with Adults

The 17 years old boy arrested on charge of raping 17 years old girl on 8 October has been kept along with adults in the district jail. The victim’s family filed a case against accused boy on 9 October at the District Police Office.

On the basis of the filed complaint, an appeal was made to the court for the extension of investigation duration which led to keeping the accused along with adults the in the jail, says DSP Gyanendra Prasad Phuyal.

The victim’s health checkup was conducted at District hospital on 9 October.

District Jail’s Jailer Kulendra Khuwas says due to scarcity of a rehabilitation center, accused was kept along with the other adults,  and he will be cared properly.

Advocate Balram Bhattarai concentrates on the fact of not using any excuses as such lack of Rehabilitation center since the Children’s Law doesn’t allow of it.

Children’s law 2075, section 22, mentions about the establishment of vigilante room. For the investigation period of the accused juvenile, Government of Nepal might establish a vigilante room. According to sub part 1, if the rooms are not available then they are kept separately in every District police office.

As per the right given by Children’s law editorial work process rule book 2076 part 85 also comprehended by point 6 of the Supreme Court there are certain facilities provided in the vigilante room.

The point’s part 1(A to F) talks about drinking water, nutritional food, bedding facilities, clothing as well as toilet and cleanliness and other facilities based on the need to the weather are mentioned. But due to the authorities working against the law like the Police and the Jail management, these juveniles are not getting what they deserve.
