Call for Recommendations of Impartial and Competent Individuals for Transitional Justice Commission Positions

Twenty-six organizations, including the Conflict Victims’ Common Forum, have urged the recommendation of impartial and competent individuals for the positions in the Truth and Reconciliation Commission and the Commission of Inquiry on Enforced Disappearances. Suman Adhikari, the Founding Chairperson of the Conflict Victims’ Common Forum, stated that the government has been urged to recommend autonomous, impartial, and competent individuals for the positions in the Truth and Reconciliation Commission and the Commission of Inquiry on Enforced Disappearances through a recommendation committee via a credible, transparent, and public selection process. Adhikari added that they have drawn attention to Omprakash Mishra, the Chairperson of the committee formed to recommend officials for the commissions. Additionally, twenty-six different organizations of conflict victims submitted a 10-point memorandum to the recommendation committee on Sunday.

The government formed a committee on October 18, 2024, to recommend the appointment of officials for the Truth and Reconciliation Commission and the Investigation Commission on Enforced Disappearances. They have drawn attention to the need to recommend competent individuals this time, citing that previous commissions failed due to the appointment of officials based on political party representation. In the past, when the commissions were formed twice, the concerns repeatedly raised by the victim community and civil society for ensuring credibility were not adequately addressed.

In the press release, it is stated that the candidates recommended were those selected based on political party distribution. As a result, instead of identifying individuals with the willingness to address transitional justice processes, provide justice to victims, and possess credible plans, commitment, and capability, the commissions recommended individuals selected through political distribution. This highlights the reasons for the failure of the commissions.”

They have also demanded that the recommendation committee consult with conflict victims, civil society, experts, and stakeholders before creating selection guidelines to ensure the recommendation process is credible, consultative, transparent, and results-oriented.
