The Human Rights situation of March 2017 is not satisfactory as compared to the last month. This month, the incident of human rights violation and atrocities has increased according to the INSEC documentation. INSEC has documented five incidents of killings by state party this month.

In the month of February, the incidents of Human Rights violation and atrocities were higher as compared to the last month. The analysis based on the news published in INSEC online, similar to the last month, this month most of the district was deprived of medicine shortage. However, news regarding the destruction of physical properties in campuses, colleges in regards to the agitation against the announcement of election date by United Madhesi Morcha was published with a priority. News related to the obstruction of various political programs in Terai Madhes by Madhesi Morcha was published. The analysis of the activities such as burning effigies of prime minister and attack on the program participated by the Prime Minister raised the suspicion that agitating party is heading towards politics of restriction. Last month, eight male were victimized by state actor and 187 people were victimized by non-state actor in various incidents on human rights violation and atrocities according to the INSEC documentation. This month, 309 people were victim of human rights violation. Last month 30 male and 157 female were victimized by non-state actor.

We are pleased to inform that Informal Sector Service Centre (INSEC) has begun to publish a monthly report on Human Rights Situation of the country from this month.  The attached file has analyzed the situation of February month 2017.  INSEC has been documenting and disseminating the Human Rights situation of Nepal since 25 years. We have been documenting the incidents on Human Rights violation and atrocities through our district representatives present in all 75 districts. Similarly, INSEC has been publishing news in a regular basis through its web portal www.inseconline.org with the objective of documenting and disseminating the incident on human rights violation.  This monthly analysis is based on the news published in its web portal. The monthly report is being published on 6th of every month incorporating the human rights situation of previous month.

We have been documenting the incidents on Human Rights violation and atrocities through our district representatives actively present in all 75 districts of the nation. Similarly, with the objective of documenting and disseminating the incident on human rights violation in a regular basis, INSEC has been publicizing news through its web portal www.inseconline.org. This monthly analysis is based on the news publicized in this web portal. It is civilian’s fundamental right to consume civil and political, economic, social and cultural rights without any hurdles.

We expect that this monthly analysis will be useful to those who want to know about the situation of human rights in the country, making stakeholders accountable by publicizing the situation of human rights based on the incidents on human rights violation and atrocities, justice to the victim and action against the perpetrators through advocacy.

The Constituent Assembly (CA) has individually endorsed all articles of the draft constitution, ensuring the promulgation of the new constitution on September 20. President will announce the new constitution amid a forma event at 5 pm on September 20. CA Secretariat said that some copies of the new constitution will be published where the lawmakers would put their signatures on September 18 in their alphabetic order. CA Chairperson Subash Nembang will then validate the constitution. This is the first time in 65 years that a constitution will be promulgated by elected representatives of people through Constituent Assembly.

The Constituent Assembly (CA) has endorsed 176 of 302 Articles of the constitution bill as of September 15 evening. The meeting of CA has been put off till 10:30 am on September 16. The CA rejected the amendment proposal on reinstating monarchy registered by Chairperson of Rastriya Prajatantra Party-Nepal Kamal Thapa in today’s meeting. The meet also secured Prime Minister as executive head and president as Head of the State both to be elected by parliament.

More than six decade-long desire of Nepali people to draft constitution through Constituent Assembly has reached final stage. The secretariat of Constituent Assembly has unveiled the plan to promulgate the constitution at 5 pm on September 20. Secretariat has prepared to promulgate the constitution after sorting out amendment proposals, articles and annexes through voting. Dr Ram Baran Yadav would make the declaration of promulgation of the constitution. CA chairperson Subash Nembang is going to Shital Niwas on September 15 to extend invitation to make the declaration. Meanwhile, the voting on articles of the revised draft constitution Bill 2072 is going on. On September 13, article 1, 2 and 3 were endorsed. On September 14, 54 articles have been endorsed.

The wish of the Nepali people to draft a constitution through Constituent Assembly (CA) has finally reached its final phase. The Constituent Assembly has endorsed three articles of the revised draft of the constitution on September 13. The endorsed articles are the ones proposed as amendments to the articles of the draft which called for the amendments to part of the draft constitution.

There was no news of progress the whole day today regarding talks despite the postponement of constitution drafting and call of the three major parties to hold dialogue. Leaders of agitating sides and UCPn-M have demanded extension of constitution drafting stating that time is not enough for striking a consensus. Madhes-based parties are still not decided on talks. The agitating Samyukta Madhesi Morcha has announced that it would not sit for dialogue unless its demands are met. However, some leaders of Madhes-based parties have formally said that they are willing to hold dialogue with three major parties. Some protests held in Tarai today were peaceful. Locals said that life has been harder due to the indefinite curfew orders imposed in Jaleshwar of Mahottari and Janakpur.

Ongoing protests in various parts of the country for last 29 days have turned violent day-by-day. Agitating sides do not seem to be serious despite calls for resolution of dispute through dialogue from all sides. Five protestors have died today in police firing in Dhanusha and Mahottari. The protestors dragged out Armed Police Forces ASI Thaman Bahadur BK from the ambulance at Shankar Chok of Jalehswar as he was being taken to Janakpur Zonal Hospital for further treatment and beat him to death. The prolonged protests have made normal life harder. Looking into some activities during the protests, there are suspicions that the protest might have gone out of control of Samyukta Loktantrik Madhesi Morcha.
