SC issues order to release Biswokarma
Explaining re-arrest as illegal, the apex court has issued order to free Netra Bikram Chand-led Communist Party of Nepal (CPN) Spokesperson Khadga Bahadur Biswokarma ‘Prakanda’ from detention.
A divisional bench of justice duo, Kedar Prasad Chalise and Purswottam Bhandari, on Thursday issued the order to release him on the presence of Supreme Court Registrar.
“Re-arrest cannot be considered legal as the law apparently does not permit the litigation process being based on the evidences presented so far”, reads the SC order.
Earlier, a single bench of justice, Iswor Khatiwada, had issued directive to produce Biswokarma before the apex court within 24 hours with reasons of arrest.
Demanding release of Bisworkarma from illegal detention, petitioner Birendra Biswokarma on Sunday had filed a writ.
